Information on whistleblower protection (EU Whistleblower Directive)

 

IN VIA München e. V. - Katholischer Verband für Mädchen- und Frauensozialarbeit has set itself high quality standards in order to fulfil its mission in a professional, transparent and legally compliant manner. However, no organisation is immune to the risk of things going wrong and errors occurring. To prevent this as far as possible, IN VIA München e. V. has created a confidential framework for whistleblowers to report complaints and information about violations of legal and internal regulations. The information may concern the following elements, but is not limited to these: Fraud, corruption, criminal offences, breaches of EU law (e.g. procurement procedures), concealment of conflicts of interest or abuse of power - including sexual assault.

If someone wishes to make a complaint of this nature, we ask that they first check whether the relevant offices at IN VIA München e. V. can be informed directly. If this does not seem advisable for any reason, two different reporting channels can be used in accordance with the EU Whistleblower Directive.

At IN VIA München e. V., two people are responsible internally for checking and, if necessary, further investigating reports. The appointment of two people from different areas of work is intended to ensure mutual controlling in dealing with the reports and to avoid conflicts of interest. Only the two people who are responsible for processing reports have access to the corresponding mailbox.

In order for the complaint to be investigated, the information should include all relevant details of the matter in question, available evidence and whether the individual's identity should remain confidential. Any investigation will take place regardless of the relationship a person has with IN VIA München e. V., their position or length of service. It is also possible to provide information anonymously, but this limits the scope of the investigation as no follow-up questions are possible. If the option of sending an e-mail is used, please ensure that the e-mail address of the person providing the information does not allow any conclusions to be drawn about their identity.

The processing steps are:

  1. Receipt of the complaint will be confirmed within seven days. Confirmation is not possible for complaints received anonymously.
  2. An initial assessment of the reported matter should take place within two weeks. The duration and scope of the assessment depend on the subject matter of the incident. If necessary, a more detailed investigation will be initiated. If necessary, external bodies will be consulted.
  3. If necessary, further information will be requested from the whistleblower in the course of the investigation.
  4. At the request of the whistleblower, a personal meeting with the responsible offices of IN VIA München e. V. can also be arranged.
  5. Following an investigation, appropriate measures are initiated - this could, for example, be disciplinary proceedings or the forwarding of information to external authorities.
  6. There is transparency regarding the handling of reports. After two weeks, the whistleblowers receive written notification of the status of the investigation. If no conclusive results are available by then, further information on the outcome of the investigation will be provided within three months.

If confidentiality is desired on the part of the whistleblower, every effort will be made to keep the identity confidential. However, it may be in the nature of the information provided or due to the need for further investigation that the identity becomes known. In such cases, the possible impact of the case on confidentiality will be discussed with the whistleblower before any further steps are taken.

IN VIA München e. V. will seriously investigate all reports of misconduct. Whistleblowers are protected against their complaints leading to discrimination. Employees who use the procedure described do not have to fear disciplinary action or unfair treatment, even if their reports prove to be unfounded. However, IN VIA München e. V. reserves the right to take disciplinary or legal action against whistleblowers if they knowingly provide false information.
